These terms govern your use of the Ariafar Holding website at ariafar.nl (the “Site”). By using the Site you accept them. If you do not accept them, please do not use the Site.

1. Who we are

The Site is operated by Ariafar Holding B.V., a private limited company registered in the Netherlands, with its office at Hereplein 4, 9711 GA Groningen. Where these terms say “we”, “us” or “our”, they mean Ariafar Holding B.V.

2. What this Site is

The Site is an informational publication about our group and the companies in our portfolio. It is not an offer to sell securities, a solicitation of an offer to buy securities, investment advice, or a recommendation of any investment. Nothing on the Site creates an advisory, fiduciary or client relationship between you and us.

Information about portfolio companies and funding programmes describes our own activities. It is not a representation about the performance, prospects or value of any company, and it may be out of date by the time you read it.

3. Use of the Site

You may view the Site and print or download extracts for your own reference. You may not:

  • use the Site for any unlawful purpose, or in a way that interferes with its operation or with other users;
  • attempt to gain unauthorised access to the Site, its servers, or any system connected to it;
  • scrape, harvest or systematically extract content, except that well-behaved search-engine crawlers may index the Site;
  • reproduce, republish or redistribute Site content commercially without our prior written consent.

4. Intellectual property

All content on the Site — text, images, logos, the Ariafar Holding name and the names of our portfolio companies — is owned by us or our licensors and is protected by copyright and trade-mark law. Nothing on the Site grants you a licence to use any of it beyond what section 3 allows.

The Site links to websites operated by our portfolio companies and by others. We do not control those sites, we are not responsible for their content, and a link is not an endorsement. Your use of a linked site is governed by that site’s own terms.

6. Availability

We aim to keep the Site available, but we do not guarantee that it will be uninterrupted or error-free. We may change, suspend or withdraw any part of the Site at any time without notice.

7. Liability

To the fullest extent permitted by law, we exclude liability for any indirect or consequential loss, and for any loss of profit, revenue, business, opportunity, goodwill or data, arising from your use of the Site or reliance on its content.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

8. Changes to these terms

We may update these terms. The version published on the Site is the one that applies, and the “last updated” date above tells you when it changed.

9. Governing law

These terms and any dispute arising from them are governed by Dutch law. The courts of the Netherlands have exclusive jurisdiction, save that if you are a consumer you may also bring proceedings in the country where you live.
